I blame Truman and his "police action" BS for starting this.
Warfare and policing are not the same and the laws that apply are quite different.

Libya is outside the US legal system's jurisdiction.
International courts only have jurisdiction over signatories that choose to put themselves in their jurisdiction.
They UN is not a legal court, judge or jury - it is more like a diplomatic cover for organized crime.
And applying civil law to an EPW is a warcrime under the GC...
